All these documents were published on March 30th, 2023, and entered into force on April 1st, 2023.
Port dues shall be payable pursuant to these Regulations in respect of every ship, other than a ship referred to in section 27(2) of the Marine and Ports Services Act 2021, within the territorial waters of Bermuda lying moored, or at anchor, or at any dock or shore.
Port dues payable under these Regulations in respect of any ship shall be at the rate of $648 up to 100 metres in length overall and $15.05 per metre or part in excess of 100 metres.
The port dues payable pursuant to these Regulations shall be paid by the owner, master or agent of the ship on demand of the Director of Marine and Ports Services or of any person authorized by him in writing to receive the demand.
The port dues payable pursuant to these Regulations for each day or part of a day or visit, as the case may be, shall, if so demanded as provided, be payable during the day or part of a day on which the demand is made.
Seaborne Services Dues
Dues payable in respect of Seaborne Services shall be calculated as set out in the Schedule (see the document below).
Tender Service to cruise vessels is subject to a minimum of:
(a) three round trips for the first 12-hour period; and
(b) five round trips in any 24-hour period.
Except in the case of dues specified in Part 4 of the Schedule, all charges are subject to a 100 per cent surcharge:
(a) on Saturdays, Sundays and public holidays; and
(b) between 4:30 pm and 8:00 am on normal working days.
The pilotage dues payable under section 32C of the Marine and Ports Services Act 2021 in respect of an inward or outward-bound ship shall, where the port of destination or departure, as the case may be, is that specified in the Schedule (see the document below), be calculated at the rate specified in the Schedule in relation to that port for each metre of draught.
Where a ship is less than three metres of draught the pilotage dues payable in respect of it shall be those payable on a ship of three metres of draught.
In calculating the charges in these Regulations the base charge shall be by the metre; and any part of the metre shall be charged by the decimetre or part thereof.
Where the services of a pilot are required for a change of berth within a port the fee payable shall be as appears in the Schedule.
Where, after the coming into operation of these Regulations, the price of fuel oil is increased by an amount exceeding five cents per litre, there shall be payable, in addition to the dues specified in the Schedule, a surcharge at the rate of ten dollars and fifty cents per movement, hour, or in the case of a cruise ship, per round trip, for every five cents or part thereof by which the price is so increased.
